Abstract: As per a recent survey conducted by a leading employment services company, TeamLease Services, more than a quarter of the 350 start-ups and SMEs surveyed admitted that they prefer hiring male candidates whereas two-fifths of the remaining claimed that the additional cost of fully paid maternity leave is factored in their decision while hiring women employees. In this study, we try to see if there are any inherent drawbacks in maternity law and whether the law has reinforced greater patriarchal biases.
